Container Refund Point Application Terms and Conditions

Effective date: 1 July 2025 

 

These terms and conditions apply to anyone applying to operate a Container Refund Point (CRP) under the Queensland Beverage Container Refund Scheme. Successful applicants will be awarded a Container Collection Agreement (CCA) by Container Exchange (Qld) Ltd (COEX). This process is referred to as the CRP Application Process. By submitting an application, you agree to the terms below. 

Some sections include a brief, non-binding summary to help applicants understand the terms more easily. These summaries are for readability only and do not form part of the legal terms. 

Submitting your application 

Your application must follow COEX’s published process and include all required information. COEX may reject incomplete or non-compliant applications. 

Application requirements 

To be considered, your application must: 

  • be submitted through the CRP Application Submission Process, as published on COEX’s website; and 
  • meet all of COEX’s Application Requirements, also published on COEX’s website. These include: 
    • meeting the Qualifying Criteria (minimum eligibility standards), unless there are exceptional circumstances; 
    • addressing the Eligibility Requirements (operational and capability standards); 
    • providing all required information and documents; and 
    • meeting any additional criteria set by COEX.
Automatic rejection  Applications that do not meet the Qualifying Criteria are likely to result in the application being automatically rejected, unless there are exceptional circumstances which may be accepted at COEX’s discretion. 

 

Incomplete application  If your application does not meet the Application Requirements and/or is otherwise incomplete, it will not be treated as a valid application unless and until the missing elements are addressed to COEX’s satisfaction. 

 

COEX discretion to Reject  Even if your application meets all Application Requirements, COEX can still reject it at its discretion. 

 

 

 

Evaluation and decision making 

COEX evaluates accepted applications using published criteria. A review panel makes the decision. COEX has the discretion to accept or reject any application. 

Evaluation criteria and assessment 

COEX will assess accepted applications against its Evaluation Criteria as published on the COEX website, and which may be amended from time to time. The assessment will be carried out by COEX’s CRP Application Review Panel. 

COEX discretion 

The selection of successful applications is entirely at COEX’s discretion. This may include further steps or requests for clarification. COEX may: 

  • accept multiple applications; or 
  • choose not to accept any applications. 

 

Applicant acknowledgments 

By applying, you accept responsibility for the contents of your application and acknowledge that COEX makes no promises or guarantees. 

When you apply, you confirm that you: 

  • have reviewed all relevant materials (including the Application Requirements and these Terms); 
  • have made any further enquiries necessary for preparing your application;
  • take full responsibility for the accuracy and completeness of your application; 
  • understand that COEX doesn’t guarantee acceptance or success of any application and is not responsible for any costs you incur; 
  • understand that any responses provided as part of your application will be relied upon by COEX in evaluating your application and representations made in your application may be adopted as expected deliverables should you be successful in your application; and 
  • do not rely on any verbal or written statements from COEX that are not part of these Terms. 

 

Reliance by COEX 

COEX may rely on any information or communication you submit as part of your application, and it may become a formal commitment if you’re successful. 

COEX can rely on anything you provide or say during the application process—whether or not COEX follows up with you. This includes information provided in your application or in response to any clarifications or questions from COEX. 

Note: If your application is successful, any statements, commitments or representations you make in your application may be treated as binding commitments and included as deliverables or obligations under your Container Collection Agreement (CCA) with COEX. 

 

No contractual relationship 

This application process does not create any legal or contractual relationship between you and COEX, even if COEX notifies you that your application has been successful. No contract exists unless and until a formal agreement (in the form of a CCA or Variation Deed) is signed by COEX. 

 

Confidential information 

If COEX gives you non-public information, keep it confidential. Mark any of your own confidential information clearly. COEX may share it in limited cases otherwise. 

COEX Confidential Information  Information provided by COEX that is not public is confidential. You must not disclose it without written permission from COEX. 

 

Sharing Confidential Information  You may share confidential COEX information with your professional advisers only if they agree to keep it confidential. 

 

Applicant Confidential Information  If your application includes confidential information, clearly mark those parts. COEX will take reasonable steps to keep marked information confidential, but may disclose it: 

  • if legally required; or 
  • to its consultants, government stakeholders or advisers for evaluation or contract award purposes. 

 

Ownership and Return of Materials  All materials provided to you by COEX remain COEX’s property. If COEX asks, you must return or destroy those materials. 

 

Limitation of liability and no warranty 

To the extent permitted by law: 

  • COEX is not liable (under contract, negligence or otherwise) for any loss caused by errors or omissions in any application materials or information provided; and
  • COEX makes no warranty about the accuracy, completeness or reliability of its information (including any response to your questions during the CRP Application Process). 

 

Reservation of rights 

COEX can amend the application process at any time and is not obligated to select any applicants. 

COEX can, at its sole discretion: 

  • amend these Terms; 
  • cancel or amend the CRP Application Process; 
  • accept or reject any or all applications; and 
  • award multiple successful applications. 

 

Governing law 

These terms are governed by the laws of Queensland. COEX and all applicants agreed to submit to the non-exclusive jurisdiction of the courts of Queensland.
